When a person dies and leaves an estate of more than $75,000, the probate court in Texas will oversee the distribution of the person’s estate. The probate process transfers the decedent’s assets to those designated in the decedent’s estate plan, or, if the person dies without a will, according to the laws of intestate succession. The probate laws in Texas will also require that any debts incurred by the deceased will be paid out of the decedent’s estate.
